FREQUENTLY ASKED QUESTIONS

 

Do You Take Credit Card Payments ?

    Yes. Please call the Clerk of Court and you will be given the procedure to follow.

Can I reschedule my Court Date ?

    You may reschedule your Court date one time by calling or writing to the Clerk of Court.

I missed my Court date and really wanted to appear ?

    To get a matter re-opened, you must write a letter stating the reasons you wish to do so or 

    the reason you missed your court date. The Judge may charge a re-opening fee up to $50.

Can I get an extension to pay my fine ?

    Yes. Call the Clerk of Court who will develop a “Payment Agreement” which will be 

     signed by the Judge and yourself with a payment schedule.

What happens if I ignore my citation ?

    The Judge will find you Guilty by “Default Judgment” on your scheduled court date. 

     You will receive a notice and be given 60 days to pay the forfeiture. If you fail to pay 

     your drivers license may be suspended and a “warrant” for your arrest or a “writ” for a

     jail sentence will be issued by the judge.

I have never been in Court, what is the procedure ?

     Please review the Court Procedure which appears below. If you have other questions, 

     call the Clerk of Court.

Court Procedure

Since most people are concerned about appearing in court, this is offered to help you understand court procedure. This court has jurisdiction over traffic and non-traffic ordinance violations in the Village of Ferryville. You have a right to be represented by an attorney, or you may go ahead without one. If you want an attorney, you must retain one at your own expense. The court cannot provide you with a Public Defender, regardless of your economic status.

Court Conduct

This is a court of law and the rules of proper decorum will apply. Please remain quiet and turn off cell phones while the court is in session. This is a courtesy to other defendants as well as the court. Persons who fail to conduct themselves in an orderly manner may be cited for contempt.

Initial Appearance

When your name is called please move promptly to a position in front of the Judge. The charge(s) against you will be read. You must respond to the charge(s) by making a formal plea: Guilty, No Contest or Not Guilty.

Guilty-This is an admission of guilt. The arrest report will be reviewed and you will be given an opportunity to make a statement of explanation.

No contest-This is a plea of guilt, but without the admission of civil liability. The arrest report will be reviewed and you will be given an opportunity to make a statement of explanation.

Not Guilty- This means that you believe you have not violated the law in the manner and form as charged against you. The case will be adjourned for trial on another date.

If you are not prepared to enter a plea, you may request a continuance. If you do not understand the pleas as described above do not hesitate to ask the judge for clarification.

If you are found guilty, a forfeiture plus court cost, jail fee and penalty assessment will be imposed. If you plead "NOT GULITY", the clerk of court will notify you by letter of the date of your trial. However, at the end of today’s court session you will be given the opportunity of a pre-trial conference with the police officer.

Payment of Forfeiture/Fines

You are expected to pay the imposed fine today. If you are unable to pay at this time, the court can give you an extension. Should you fail to pay the forfeiture, the judge can:

                          1) Suspend your driver's license for not less then 30 days nor more then 5 years.

                          2) Issue a warrant for your arrest .  

                          3) Commit you to the County Jail for a period not exceeding 90 days.                 

Court Trial Procedures

Trials will be conducted following the rules of evidence. The Village will be represented by an attorney, and will be responsible for all witnesses he wishes for testimony in the trial. If you wish to have an attorney represent you or have witnesses testify in your behalf, it is your obligation to have them present at the time of trial. A continuance will not be granted because an attorney or witness cannot make the trial date. If you are found guilty, you will also be assessed a $16.00 witness fee for each witness called by the Village Attorney. If you fail to notify the Clerk of Court in writing at least 72 hours before your trial date, that you will not be attending your scheduled trial, an additional $50.00 fee will be imposed by the Judge.
