                                VOTING BY ABSENTEE BALLOT

SPRING ELECTION – APRIL6, 2010

 

Any qualified elector who is unable or unwilling to appear at the polling place on election day may request to vote an absentee ballot.  A qualified elector is any U.S. citizen, who will be 18 years of age or older on election day, who has resided in the ward or municipality where he or she wishes to vote for at least 10 days before the election.  The elector must also be registered in order to receive an absentee ballot.

 

TO OBTAIN AN ABSENTEE BALLOT YOU MUST MAKE A REQUEST IN WRITING.

 

Contact your municipal clerk and request that an application for an absentee ballot be sent to you for the primary or election or both.  You may also request an absentee ballot by letter. Your written request must list your voting address within the municipality where you wish to vote, the address where the absentee ballot should be sent, if different, and your signature.

 

Special absentee voting application provisions apply to electors who are indefinitely confined to home or a care facility, in the military, hospitalized, or serving as a sequestered juror.  If this applies to you, contact the municipal clerk.

 

You can also personally go to the clerk's office or other specified location, complete a written application, and vote an absentee ballot during the hours specified for casting an absentee ballot.

                                                     AN ORDINANCE CREATING

CHAPTER 23 OF THE MUNICIPAL CODE OF

THE VILLAGE OF FERRYVILLE, CRAWFORD COUNTY,

WISCONSIN

 

The Village Board of the Village of Ferryville, Crawford County, Wisconsin does ordain as follows:

Section 1 – The title of this ordinance is the Village of Ferryville CITATION       

 ORDINANCE. 

Section 2 – AUTHORITY

The Village Board, of the Village of Ferryville, Crawford County, Wisconsin has the specific authority under s. 66.0113, Wis Stats. to adopt this ordinance.

Section 3 – ADOPTION OF ORDINANCE

The Village Board, adopted on proper notice with a quorum and by vote by a majority of the Village Board members present and voting, provides the authority for the Village Board to designate that the Village Clerk/Treasurer may issue citations for violations of the Village of Ferryville ordinances, including ordinances with statutory counterparts.

Section 4 – COVERAGE

Except as provided in subsections g (4) and g (5), the form for citations to be issued in the Village of Ferryville, by the Ferryville Village Clerk/Treasurer for violations of the Village of Ferryville code of ordinances shall include the following:

a)      The name and address of the alleged violator.

b)      The factual allegations describing the alleged violation.

c)       The time and place of the alleged violation.

d)      The number of the ordinance violated.

e)      A designation of the offense in a manner that can be readily understood by a person make a reasonable effort to do so.

f)       The time the alleged violator may appear in court.

g)      A statement that in essence informs the alleged violator of all of the following:

1)      That the alleged violator may make a cash deposit of a specified amount to be mailed to a specified official within a specified time.

2)      That if the alleged violator makes a cash deposit, he or she, need not appear in court unless subsequently summoned.

3)      That if the alleged violator makes a cash deposit and does not appear in court, he or she either will be deemed to have tendered a plea of no contest and submitted to a forfeiture, plus costs, fees,  and  surcharges imposed under Chapter 814, Wis Stats., not to exceed the amount of the deposit, or will be summoned into court to answer the complaint if the court does not accept the plea of no contest.

4)      That if the alleged violator does not make a cash deposit and does not appear in court at the time specified, he court may issue a summons or a warrant for the defendant’s arrest or consider the nonappearance to be a plea of no contest and enter judgment under s. 66.0113(3)(d), Wis. Stats., or the municipality may commence an action against the alleged violator to collect the forfeiture, plus costs, fees and surcharges imposed under Chapter 814, Wis. Stats.

5)      That if the court finds the violation involves an ordinance  that prohibits conduct that is the same or similar to conduct prohibited by state statute punishable by fine or imprisonment or both, and that the violation resulted in damage to the property of or physical injury to a person other than the alleged violator, the court may summon the alleged violator into court to determine if restitution shall be ordered under s. 800.093, Wis. Stats.

h)      A direction that if the alleged violator elects to make a cash deposit, the alleged violator shall sign a appropriate statement that accompanies the citation to indicate that she or he read the statement required under s. 66.0113(1)(b)7, Wis. Stats., and shall send the signed statement with the cash deposit.

i)        Any other information as may be deemed necessary.

 

Section 5 – PENALTIES OR FORFEITURES

Penalties or forfeitures for citation violations shall be set forth as in each applicable portion of the Code of Ordinances or other ordinance.

 

 

Section 6 – ISSUANCE AND SERVICE OF CITATIONS

The Village of Ferryville Village Board has designated the Village Clerk/Treasurer to serve any citations for the Village of Ferryville upon issuance.

Section 7 – RELATIONSHIP TO OTHER LAWS

The adoption and authorization for use of a citation under this ordinance does not preclude the Village Board of the Village of Ferryville from adopting any other ordinance or providing for the enforcement of any other law or ordinance or providing for the enforcement of any other law or ordinance relating to the same or any other matter. The issuance of a citation under this ordinance does not preclude proceeding under any other ordinance or law relating to the same of any other matter. Proceeding under any other ordinance or law relating to the same or any other matter does not preclude the issuance of a citation under this ordinance. 

Section 8 – SEVERABILITY

If any provision of this ordinance or its application to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid  provision of application, and to this end, the provisions of this ordinance are severable.

Section 9 – EFFECTIVE DATE

This ordinance is effective on the day following posting under 60.80, Wis. Stats. Adopted this 24th day of February, 2010 by the Village Board of the Village of Ferryville, Wisconsin.

2009 VILLAGE OF FERRYVILLE ACTIVITIES

Report by Alan Kirchner, Village President

As Village President, it is very pleasing for me to outline several accomplishments, and recognize groups and people, for projects in our Village during calendar year 2009. I have not listed these in any order of priority or importance. I think you will see that many major projects were completed in 2009 and many people made it all happen. Lastly, I wish to thank Sherry Quamme and Bridget Schill for their dedicated service to Ferryville. Sherry has served as Clerk/treasurer and Treasurer since November of 2005. Bridget has been our Clerk for the past two years.

  • COMPREHENSIVE PLAN -

The Plan Commission worked diligently to draft the Plan and after hours of

efforts held the public hearing with the Village Board and on December 16,

2009 the Board adopted Ordinance Chapter 22 approving the Plan. It was

mailed into the state prior to the 01/01/2010 deadline, something many

communities failed to get done. Our Thanks is extended to the Plan

Commission.

  • SEWER RENEWAL PERMIT –

Our Waste Water Permit was renewed by the DNR on 10/01/2009 for the next 5

years, following 6 months of efforts by John Lomas, our Operator and

volunteer residents Larry Quamme & Cliff Lawson. No funds were expended

for the renewal, something that few communities experience.

  • SALE OF LAND & EASEMENT -

The parcel of land, and easement beneath Lagoon Street, for the Bureau of

Aeronautics -City of La Crosse Airport Project, to develop a wetlands area

behind the Arnold Harris property, was completed with receipts of $4,500 plus

reimbursement for legal and closing costs. Again Thanks to the Plan

Commission for many hours of work and also free donated time by Cliff

Lawson, a registered engineer, which saved costs to the village.

  • NEW "WELCOME TO FERRYVILLE" SIGNS –

I think everyone has seen the new lighted Welcome Signs. A special thanks

for funding to make these possible goes to the Tourism Council, Booster Club,

an anonymous donor ($1,000), and Jim Smith. The Berglin Family is also

donating funds for landscaping next spring. Also special thanks, to those who

joined me installing the signs, Larry Quamme, Cliff Lawson, and Roger Wee.

  • GOVERNOR LUCEY HISTORICAL MARKER –

September 28, 2009 marked the dedication of the new marker with Governor

Doyle, and past Governor’s Tony Earl and Martin Schreiber attending along

with former Governor Patrick Lucey. The Village will probably never again be

visited by 4 governors on the same day. The marker was a special gift to the

Village by the Vision and Promotion Board (FV&PB) coupled with an

additional $7,000 in donations by the Governor’s friends. A luncheon followed

served by ladies of Utica Lutheran Church and students from the De Soto

school. Sherry Quamme headed the project and many people worked very

hard to make this a special historical day in Ferryville. Thanks to all.

  • MISSISSIPPI RIVER CHANNEL MARKERS –

The "Friends of Pool 9" donated $800 which was quickly matched by the

Ferryville Vision & Promotion Board(FV&PB). Additionally donations were

also received from the Tourism Council, the Sportsman Bar, the Wooden

Nickel, the Swing Inn and the Booster Club to finance the $2,200 project. Many

volunteers helped to build new buoys, gain approval for the DNR permit, and

the channel was marked under the guidance of Jerry Boardman (member of the

"Friends") and Todd Lensing.

  • MARKET STREET RAIL CROSSING IMPROVEMENT –

The Village was informed that Federal Stimulus funds would be used to repair

and pave the rail crossing on Market Street. The Village joined the effort,

replacing the street storm drain, removed the road hump, and repaved a

portion of the street, spending $5,500.

  • RIVER BLUFF DAYS -

The celebration was special in 2009 with the Ferryville Antique Tractor

Association sponsoring a very successful tractor pull. The FV&PB sponsored

children’s activities during the Pull and the FV&PB sponsored the $3,000

fireworks show in the evening that was second to none. Special Thanks to the

many people that worked so hard.

  • FIRE DEPARTMENT UP-GRADE –

The Village Board worked with the Fire & First Responders Department to

replace the 46 year old "Brush Fire Truck". The Department and the Board are

working toward the goal of getting the fire protection class reduced which would

lessen the cost of homeowner insurance premiums to the residents. The new

truck is scheduled for delivery early in 2010.

  • ENERGY GRANT & E-3 COLALITION –

The Village Board has applied for a grant to replace lighting, insulation, and

the heating systems in the Village Hall, Fire Department, and DPW Garage.

The Village has also joined 12 other municipalities in the area to seek more

funding to reduce the use of energy. Thanks to those who worked hard to make

this happen.

  • PARK IMPROVEMENTS –

The Village improved campsites at Sugar Creek Park and the FV&PB

purchased a new flag pole, with lighting at the park entrance. Camper fees for

2009 amounted to $1,162, $412 more than anticipated in our budget. The

FV&PB is also experimenting with solar lighting of the flag at the boat landing.

  • VILLAGE OWNERSHIP – FERRYVILLE CEMETERY

At the request of the Cemetery Association, the Village accepted transfer of the

land and adopted Ordinance Chapter 19 which created a "Cemetery

Committee" to operate the cemetery. Funds were transferred to Village

Accounts and are handled by the Village Treasurer.

 

  • OTHER VILLAGE PROJECTS –

    • The Village bid & contracted the court ordered drainage changes at the old

school house property.

    • Additional flags are erected on special days on Main street as a result of the

generous gift of flags by the Antique Tractor Association.

    • A new sign at the Boat Landing "Leave No Trace" was donated and

installed by the "Friends of Pool 9".

    • Repairs to Village Hall roofs were completed, a new ceiling installed,

a downspout drain system completed, shutters replaced and some

painting also completed.

    • The electrical panel and anti explosion modifications were completed at the

North lift station per DNR specifications.

    • LRIP funding was applied for and received for a 2010 paving project on

River Bluff Drive.

    • New 15 minute parking was added in front of the Bank for convenience and

increased safety for after dark use of the ATM.

    • The sanitary sewer issue at the Ferryville Garage was corrected and

approved by the DNR.

- Repairs to the ceiling in the shelter at the Boat Landing were completed.

  • 2009 VILLAGE BUDGET –

I want to express special appreciation to the Village employees and to members

of the Village Board. Careful spending allowed us to return unspent monies in

our general budget to the "Fund Balance" in the amount of approximately

$7,700. Similarly, approximately $6,700 was Added to our "Fund Balance &

Replacement Fund" in the sewer utility account because of reduced and careful
