building permits are required by Village Ordinances, These
are:
- The construction, or alteration of, one and two family
dwellings
- The construction, or alteration of, detached
structures

15.01
AUTHORITY. These regulations are adopted under the authority
granted by s. 101.65, Wisconsin Statutes.
15.02
PURPOSE. The purpose of this ordinance is to promote the
general health, safety and welfare and to maintain required local
uniformity with the administrative and technical requirements of the
Wisconsin Uniform Dwelling
Code.
15.03
SCOPE. The scope of this ordinance includes the construction
and inspection of one and two family dwellings built since June 1,
1980. Notwithstanding s. Comm 20.05, the scope also includes the
construction and inspection of alterations and additions to one and
two family dwellings built before June 1, 1980. Because such
projects are not under state jurisdiction, petitions for variance
and final appeals under ss. Comm 20.19 and 20.21, respectively,
shall be decided by the Village Board of Appeals. Petitions for
variance shall be decided per s. Comm 20.19 Intro) so that
equivalency is maintained to the intent of the rule being
petitioned. As the Board of Appeals approves petitions for variance,
the Building Inspector is granted the power to apply the results to
similar circumstances by precedent. The building structure and any
heating, electrical, or plumbing systems shall comply with the
Uniform Dwelling Code. Petitions for variance and appeals shall be
handled as noted in the paragraph.
15.04
WISCONSIN UNIFORM DWELLING CODE ADOPTED.
The Wisconsin Uniform Dwelling Code, Chs. Comm 20-25 of the
Wisconsin Administrative Code, and all amendments thereto, is
adopted and incorporated by reference and shall apply to all
buildings within the scope of this
ordinance.
15.05
BUILDING INSPECTOR. There is hereby created the position of
Building Inspector, which shall be by contract with the Village
Board, and the contract renewed annually, who shall administer and
enforce this ordinance and shall be certified by the Division of
Safety and Buildings, as specified by Wisconsin Statutes, section
101.62 (2), in the category of Uniform Dwelling Code Construction
Inspector. Additionally, this inspector shall possess the
certification of UDC HVAC, UDC Electrical, and UDC
Plumbing.
15.06
BUILDING PERMIT REQUIRED.
If a person alters a building in excess of $3,500.00 value in any
twelve month period, adds onto a building in excess of 100 square
feet in any twelve month period, or builds a new building, within
the scope of this ordinance, they shall first obtain a building
permit for such work from the Village Building Inspector. Any
structural changes or major changes to mechanical systems that
involve extensions shall require permits if over the forging
thresholds. Restoration or repair of an installation to its previous
code- compliant condition as determined by the Village
Building
Inspector is exempted from permit requirements. Residing,
re-roofing, finishing of interior surfaces and installation of
cabinetry shall be exempted from permit
requirements.
15.07
BUILDING PERMIT FEES. The building permit fees shall be
determined by Village Board resolution.
15.08
EAGLE MOUNTAIN SUB-DIVISION RESTRICTIONS. The
following restrictions apply to new dwellings constructed in the
Eagle
Mountain
sub-division:
a)
The dwelling shall not be visible from Highway 35, the
Great River
Road, during summer
months.
b)
No part of the dwelling can be placed within the road
right-of-way set back line of 30 feet.
c)
Inside living space, excluding basement and garage area must
be 750 square feet or greater.
d)
No permit may be granted for placement of a mobile home or
trailer.
e)
Property sites must be graded to prevent landslide and
include an erosion plan to prevent loss of
soil.
f)
Restrictions (a), (b) are exempted for Eagle
Mountain
sub-division lots “1 south thru 9 south”.
15.09
PENALTIES. The enforcement of this section and all other laws
and ordinances relating to building shall be by means of the
withholding of building permits, or imposition of forfeitures and
injunctive action. Forfeitures shall be not less than $25.00 no more
than $1,000.00 for each day of
noncompliance.
15.10
EFFECTIVE DATES. This ordinance became effective January 1,
2005, and was amended July 20, 2005, and was amended September 17,
2008.

NOTE: The permit fees cover all calls,
meetings, plan review, inspection trips, travel, reporting to the
State and Village. Fees cover the project from start to finish.

Building Permits
Required
A)
Persons building
new detached structures within the Village, of more than 100 square
feet, and not subject to the Wisconsin Uniform Dwelling Code, and
not subject to the Wisconsin Commercial Building Code, must obtain a
Village of Ferryville approved and issued Building Permit, which
must be displayed at the construction site during construction.
B)
Persons intending to complete alterations to detached
structures, defined
in 14.01 (A), in excess of $3,500 in a 12 month period, or
adds more than
100 square feet, are required to obtain a building permit
approved and
issued by the Village of Ferryville, which must be
displayed at the
construction site.
14.02
Building Site
Inspection Committee Duties -
Compensation
A)
The Village President, shall on an annual basis, at the
Village Board
Meeting in May, appoint 2 members of the Village Board to
serve as a
“Building Site Inspection Committee”.
B)
A site inspection shall be conducted by the Committee
following
application for a building permit required by 14.01 and each
member of
the Committee will receive compensation of $15.00.
Inspections are
limited to review of standards contained in 14.04 (A) and
(B).
C)
The Committee shall make a recommendation to the Village
Board for
approval or denial of the application for a building
permit.
14.03
Building Permit
Application and Fees
A)
The application, for a permit required by this chapter, shall
include:
1)
Name, address, phone number of the
applicant
2)
Address of the building property
site
3)
A plot plan drawing of the property showing the building site
location and distance from all 4 lot lines
4)
An erosion control plan
5)
Square footage of the structure
6)
Building type (structural frame)
7)
Exterior finish material
8)
Intended use of the structure
9)
Visibility from Highway 35 (if applicable in
14.04)
B)
Applications shall be obtained from and returned to the
Village Clerk thirty (30) days prior to start of intended
construction. The Village Clerk shall issue permits following
approval of the application by the Village
Board.
C)
The building permit application fee shall be
$55.00.

Standards for
Construction of Detached Structures
A)
Eagle Mountain Sub-division
restrictions:
1)
Detached structures cannot be placed within the road
right-of-way set back line of 30 feet.
2)
Any part of a detached structure cannot be built which can be
seen from Highway 35 during summer months.
3)
Property sites must be graded to prevent landslide and
include an erosion control plan to prevent loss of soil.
4)
Detached structures placed less than 10 feet from a
“dwelling” or less than 3 feet from a property line are subject to
the requirements of Wisconsin Administrative Code “Comm
21.08”.
5)
Restrictions (1) and (2) do not apply to Eagle
Mountain
property lots “1 south thru 9 south”.
B)
All other Village property
locations:
1)
Property sites must be graded to prevent landslide and
include and erosion control plan to prevent loss of
soil.
2)
Detached structures placed less than 10 feet from a
“dwelling” or less than 3 feet from a property line are subject to
the requirements of Wisconsin Administrative Code “Comm
21.08”.
14.05
Structure
Completion Requirements and Variance
Requests
A)
Final construction of a structure, granted by a Village
building permit, must be completed following twelve (12) months from
the issue date of the permit.
B)
The Board may approve an extension of the permit, for
completion of the
structure, for a period of an additional 12 months. The
person, to whom
the permit is issued, must seek an extension of the permit,
in writing to
the Village Clerk, prior to the expiration of the original
permit period.
C)
Persons may seek a variance to the standards of 14.04, and
the Village
Board, following a hearing on the request, may grant a
variance and
approve and issue the Building Permit.
14.06
Penalty
Provisions
A) Any person or entity
violating any part of this ordinance shall be subject to the
following penalties:
1)
Revocation of the building permit may be issued by the
Village
Board.
2)
Penalties as set forth in Section 13.04 of the municipal code
of ordinances for the Village of Ferryville may be applied.
